My Practice

[Mary Alice McLarty]My Practice has developed and matured over the last twenty-two years. I handle significant and complex cases. We handle hazing, premises liability cases, trucking accidents, construction site accidents, severe injury cases and cases involving misrepresentations by realtors and builders. I often associate with other lawyers, with whom I have developed associations through the years.

We represent hazing victims. We are representing a young man who was forced to drink gallons of water at a fraternity party and almost died. He was in a coma for days. For instance, we assembled a dynamic, trial team of four lawyers and a support staff, to represent 58 former cadets of a military school and their families. To gain the students and their tuition, the recruiters of this school would make glowing presentations to parents as to the "great" job they did in making boys into men. However, these parents were knowingly misled as to quality of the care and education their sons would receive at this academy. Our clients' sons were mistreated, hazed, and assaulted, some sexually. This case has now settled.

My firm is currently working on a premises liability case, where a man who was fatally injured after he fell into a lube pit which was not covered by the OSHA required grates. We also represent a man who was crushed by a pallet jack operator who swung a load of metal beams into his body and crushed him against the side of the freight elevator. The young man now suffer from Complex Regional Pain Syndrome (also know as RSD).

In another case, I was on the trial team who represented a jailer in a whistle blower suit against a sheriff in West Texas. The jail employee was fired for reporting a violation of safety regulations to the Department of Health. She and her fellow employees were having to clean with caustic and toxic chemicals without any rubber gloves, boots, masks or other required protective gear. When she complained to her supervisors, they told her to shut up and go back to work. She called the Department of Health, which resulted in an inspection and fine for the county jail. She was suspended and later terminated on a pre textual basis. The jurors found that she was terminated due to her report to the law enforcement agency. She was awarded a seven figure verdict which was affirmed by the Texas Supreme Court.

The Texas Supreme Court also recently affirmed a verdict against an owner of a trucking firm, who fired his employee (our client) for not fraudulently altering an insurance claim form. He wanted her to alter the VIN number of the trailer, in order to collect insurance proceeds. She refused and was fired. We prevailed and won her a substantial verdict.

I do not practice family law, employment law, criminal law or real estate law. I practice only personal injury and civil trial law. We seek Justice for our clients and will fight for them in order to get it.
